Is an idea permanent and "ownable" if it is not tangible?
Yes, people buy and sell "the rights" to intangible intellectual property every day. (proposed scripts, proposed novels, concepts for albums, etc).
Napster, and the still unavailable 'moviester' (waiting on bandwith and DVD penetration only) are in the business of giving away these previously intangible, and lucrative products.
If anyone with DSL and a burner can download StarWars episode 2 before it hits the big screen.... is that a good or bad thing? Is that blackmarket or the ultimate revenge of the consumer?
What happens in the courts, and more importantly what happens on the net, will develop into a very interesting redefinition of what "ownership" is and isn't.
